Here is the scenario … what should we do?

We have been living in a house with a 3rd person for 5 mths. Recently we found out he has only paid 3wks worth of rent.
He has been lieing to us and the realestate.
Stolen money and my friends Ipod (but returned it eventually).
We have now been evicted.
The agent has said we can take out another lease if the 3rd person isn’t here.
We can’t get him out, we’ve asked him to leave. I’ve packed his gear and shoved it in a corner. Personally I want to toss the lot on the street but friend won’t let me.
Any ideas on what I should do… Short of murder?

If you take out another lease on the same place you’re gonna be stuck with that freeloader, and it will be YOUR problem to get rid of him, not the landlord’s. The only way I’d renew a lease with your landlord is if he/she is willing to let you two honest ones rent another unit/house…. leaving the eviction/police calling/whatever to the landlord.

From what I understand, in most places (in America) your freeloader could turn around and sue you… and WIN… if you toss his stuff out. Then, not only would you be out of a home, but paying that jerk for whatever he and the courts decide is the ‘value’ of his property. It’s not worth it, so resist the temptation. That’s probably what he’s HOPING you’ll do.

He’s squatting. For an example of the nightmare you could face if you renew your lease and have him still in your house, read the link below. {shudder}… how’s THAT for food for thought?

Also, do a Google search for Tenant Rights in the place where you live. It may shed some light on what ‘rights’ HE has, and how they could adversely affect you.

Are Previouse Owners Liable For Damages To My House?

We purchased a house July 17, 2008.
The sellers disclosed that they had the roof "torn off and replaced" with 30 year shingles in April 2008.
New roof right?
Now we have several leaks, ice damn build ups and a tube they put in from the roof into my pantry to detour the water into a bucket! They hid the tube up in the ceiling and we just found it.
We found out that they repaired the roof themselves. We did have the home inspected.
Now the roof needs to be replaced again and there is damage to our siding from water leaking down the walls!!!

We had a couple estimates done. Due to the pitch of part of our roof, it should have been wrapped with special stuff to protect it from water and ice. This is "code" or required. They did not do this either!

My realestate agent says we have to try and get them to settle or go to arbitration.

Are they liable? Did they defraud the insurance company by "fixing"it themselves and not fixing it up to code?

I’m worried now about our walls and what if MOLD happens!!!
Can someone offer advice here as the previouse owners are now living in New Zeland.

Until your last sentence you had a lot of possibilities, but I have a question for you. You said you had an inspection done, why aren’t you going after them? If they were licensed then you based your decision on buying your house I am assuming because they told you it was in good condition?

Ok so heres the story. about a month ago i found this house i absolutely love and when i went to get info on it and possibly put an offer on it i was told it went in to escrow and it was very rare for peoples loans to fall thru at that point and have the house open back up so my realestate agent basically told me that house was hopeless and keep moving. the house also went "inactive" on the website i found it on.
so kept looking for a house and nothing has compared.

but just a few minutes ago i was sent an email saying one of my saved home listings had been updated. i looked to see what home.. and there i was the house that was hopeless to get.
i researched it on another website and there it was….
im trying real hard not get my hopes up.

do you think the home is actually for sell again?
this seems to be a sign that this is supposed to be MY home

also me and my boyfriend make about 3000 dollars a month and dont have much debt do you think we can afford a 88 thousand dollar house? we both have pretty good credit scores also

i sure hope this isnt some sort of glich and my house is really gone.

There may have been family problems too so that the house couldn’t be sold until all the heirs agree. All I can tell you about buying a house, is that you don’t want to get too enthused so that you inspect it very very carefully and be sure it is worth the $. Have all the right inspections done and look for damage and check out the neighborhood. $3000 is not a lot of money when it comes to home ownership. They cost a lot and there are always repairs and some can be extremely expensive. Be sure you don’t get in the mess so many others are and buy something you really can’t afford. Anything can go wrong in your life like lose your job, have health problems, bad car wreck and then there is the weather problems like hail damage, tornadoes and hurricanes and all of that. Be sure you have enough $ to tide you over a pretty good time . . .like six months saved up and then a good savings account for when the house needs fixing, and then a tidy down payment. Without all of that, don’t buy a house. Nothing is worse in a relationship than to be short of money so that you have to constantly worry about how you are going to pay the bills and then you want to have enough to have some fun and you need to be saving on a regular basis. Plus you are moving in with no commitment from your bf. What happens if you break up? Protect yourself very carefully. . .always. . . .Good luck!

What’s the law??

I know in certain States and countries it is mandatory for a realestate agent to tell thier clients if there are physical damages to the house.

But is it madatory to tell the clients if there are things that happened in that house like a murder or suicide or if it was a crack house??

for exaple if a couple with thier kids move to a new town and they are not aware that the worst murder that town has seen happened in the house that they are buying. And the realator does not tell them and sells it for the going rate in that area. Once the couple finds out they are creeped out and want to move but no one wants to buy that house if they sell it they would probably take a loss in the price.

Is it law for the realetor to disclose that information in certain states or countries.
What is the specific law and how does it work?

My father taught real estate classes. In most state (their can be a exception but I don’t think their is one) you must disclose any murders, death, or suicides that had happened in the house. If the real estate agent doesn’t disclose this information the agent and the company they represent can be sued for not disclosing such information. Check with the local jurisdiction to verify.

My friend told me a story and it was pretty pointless. It went something like a realestate agent was
Looking for somewhere to stay and the only inn that he could find was the yellow vacancy the
Place he went to everything was yellow, grass dirt, house, etc. Even the lady was yellow. The room for him was yellow and everything in the house was yellow. (more yellow stuff I just don’t remember) then the next morning the guy walked downstairs and there were two other men in the yellow kitchen. On the yellow table there was two cereals. Cheerios and frosted flakes. One of the men reached for the cheerios and the guy and the other guy both reached for the frosted flakes at the exact same time. And the moral of the story is two out of three men prefer frosted flakes over cheerios.

My friend made it sound really interesting and made it funny at the end, are there anymorelike those??

One day, at recess, Jimmy asked his friend a question. His friend promptly punched Jimmy in the face. So Jimmy went home to get cleaned up. When he got home, his mother asked him what he was doing there. Jimmy told her he got punched in the face at recess. She asked why he was punched.

"Get back to school, we’ll talk about this when you get home," his mother said angrily.
So Jimmy walked back to school, but he was late for class. His teacher asked him why he was late.
"I got punched in the face at recess, so I went home to get cleaned up."

"Because I asked what purple roses are."
"Go to the principal’s office. Now."
So Jimmy went to the principal’s office and said, "I got punched in the face at recess, went home to get cleaned up, and was late for class."
"Why were you punched in the face?"

"You’re being expelled. Get out."
So Jimmy went home and locked himself in his room until his father got home.
His father asked, "Why were you expelled?"
"Because I got punched in the face at recess, went home to get cleaned up, was late for class, and was sent to the principal’s office."
"Why were you punched in the face?"
"Because I asked what purple roses are."
"Get the heck out of my house. I’m disowning you."
So Jimmy went all over the country, asking whoever he would meet what purple roses were. But everyone got very angry and told him to go away.
Eventually, he asked the president what purple roses were, and the president kicked him out of the country.
So he went to Mexico. The first person he saw in Mexico was a pretty girl. She asked, "Why are you in Mexico."
"Because I got punched in the face at recess, went home to get cleaned up, was late for class, got expelled, got kicked out of my house, then got kicked out of my country."
"Why were you punched in the face at recess?"
"Because I asked what purple roses are."
"Oh," the girl said. "That lady across the street knows what purple roses are. Ask her."
So Jimmy walked across the street, and was hit by a car. Jimmy died before he could find out what purple roses were.
The moral? Look both ways before you cross the street.
